Conditions for Delivery and Payment

If not agreed otherwise our prices are quoted ex-Herxheim and do not include freight and packing. Shipping risks and costs on behalf of the customer.
If not agreed otherwise the pricing as stated on the day of delivery is applicable.
The delivered goods maintain property of WiMo until fully payment of all invoices is received.
Warranty claims as covered by German law will be granted by our discretion by another delivery or replacement delivery. Further claims (based on specifications) are not covered. In such cases where replacement fails repeatedly the customer has the right to reduce price, get refund or receive a substitution. In case of a defect please inform WiMo within 10 days in writing.
Other than above provisions of the buyer versus the seller and his employees are excluded. This is in particular true for any continuous damages.
We do not accept any damages covering persons or goods that may occur during installation or de-installation or during operation or any other use of goods purchased from WiMo.
Return of non-defective merchandise will be subject to authorization by us. Credits for returned merchandise (it must be like new with all original packing) will be subject to a restocking fee. No returns on customer-specific orders except in case of a defect accepted by WiMo.
All offers are valid as long as merchandise is in stock; WiMo is not responsible for typographical errors or omissions, changes in price or technical models.
Should any clause of these conditions be invalid or unenforcable this shall have no effect upon the validity of the remaining clauses of these conditions. The"Conditions for Delivery and Services of the Electrical Industry in Germany"(ZVEI) shall govern these conditions.
Place of arbitration is Landau/Pfalz. In case of doubt the German version of the 'Condition for Delivery and Services" shall govern.
